1.    Who is entitled to my estate if I die without a Last Will and Testament?

    If a person dies without a Last Will and Testament, then the person has died intestate.  Sections 38 and 45 of the Texas Probate Code provide the basic rules for descent and distribution of an intestate decedent’s estate.  These rules differentiate between a decedent who is survived by a spouse and one who is not.
